Keys to Efficient and Cost-Effective Divorce Cases

One of the most important questions a person might have when thinking about their divorce case is: What is this going to cost me? And for good reason - a divorce is a time of financial change and sometimes uncertainty. Some call it an unwinding of a business partnership, and it really is just that (and more).

The answer to that question is almost impossible to know at the outset of a divorce case. We can estimate and create a budget, but so many variables can increase or decrease the cost. The best, most efficient and cost-effective plan is one that is deliberate, and that starts at the first meeting. Here are some keys:

Know your case and help your attorney know your case - This seems elementary, but the best thing you can do is spend time with your attorney really getting to know your case with them. They will help you identify the legal and factual issues that can be dealt with quickly and easily, and identify those that might take a bit more time or effort to resolve. A good attorney will identify your potential exposure so that you can make informed decisions on how to proceed.

Communicate effectively - Cooperative resolutions of cases (settlements) are very often assisted by open and civil communication. It is very rare that a settled case gets both parties exactly what they want - fair compromises are the name of the game. Without communication, trust is hard to come by and that makes compromising more difficult. Moreover, communicating the reasons behind your most important issues can build a consensus on what needs to happen.

Be prepared - If settlement discussions aren’t productive, be prepared to ask your judge for what you want. It’s the same principal as buying a used car - if you don’t like the deal you’re getting, go home. When you know what you can get in court, you don’t have to make an unfair compromise. While outcomes in Court can’t be guaranteed, a good divorce attorney will explain to you what to expect and how to get there. Listen to their advice and make an educated decision.
